The Digital Millennium Copyright Act provides a process through which copyright owners may notify online service providers of material they believe infringes their copyrights.

This policy describes how copyright-related complaints concerning material appearing on wearnorules.com may be submitted to Wearnorules.

Submitting a DMCA notice does not automatically establish copyright infringement. Each notice will be reviewed based on the information provided and applicable law.

2. Scope

This policy applies to copyright concerns involving material appearing on or accessible through wearnorules.com, including where applicable:

  • Product photographs
  • Product images
  • Written descriptions
  • Website graphics
  • Artwork
  • Videos
  • Marketing materials
  • Blog or informational content
  • User-submitted content, if available
  • Other copyright-protected materials

Trademark and other non-copyright intellectual property complaints should be submitted under our Intellectual Property Claim Policy.

  • Email: support@wearnorules.com
  • Mailing Address: 560 Norton Pkwy, New Haven, CT 06511-1634, United States
  • Support Hours: Monday–Saturday, 8:00 AM–7:00 PM Eastern Time (ET)

For email submissions, we recommend using the subject line: DMCA Copyright Infringement Notice or DMCA Counter-Notification depending on the nature of your submission.

4. Who May Submit a DMCA Notice

A copyright infringement notice should be submitted by:

  • The copyright owner; or
  • A person authorized to act on behalf of the copyright owner.

If you are submitting a notice on behalf of another person or organization, you must have authority to represent the copyright owner regarding the claimed infringement.

5. Requirements for a DMCA Copyright Notice

To allow us to properly evaluate a copyright infringement notice, the notice should include the information required under applicable law.

A valid notice should contain:

  • A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • If multiple copyrighted works on the website are covered by one notice, a representative list of those works where legally permitted.
  • Identification of the material claimed to be infringing or the subject of infringing activity.
  • Information reasonably sufficient to allow us to locate the material.
  • Information reasonably sufficient to allow us to contact the complaining party.
  • A statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate.
  • A statement, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Incomplete notices may delay our ability to review or respond to a complaint.

6. Identification of the Copyrighted Work

Please describe the copyrighted work clearly.

Where available, include:

  • Title of the work
  • Name of the copyright owner
  • Name of the author or creator
  • Original publication URL
  • Original publication date
  • Copyright registration number
  • Registration date
  • Supporting ownership documentation

If the complaint concerns an image, provide the original image or a reliable location where the original image can be reviewed.

7. Identification of the Allegedly Infringing Material

Your notice should identify the allegedly infringing material with sufficient detail for us to locate it.

Please provide:

  • Exact URL of the relevant page
  • Product name, if applicable
  • Description of the disputed material
  • Screenshot, where useful
  • Location of the material on the page
  • Any other information that reasonably helps identify the content

A general statement that the entire website infringes copyright may not provide enough information for us to locate or evaluate the specific material.

8. Contact Information Required

Please provide sufficient contact information, including:

  • Full legal name
  • Company or organization name, if applicable
  • Mailing address
  • Email address
  • Telephone number, where available

This information may be necessary for processing the notice and communicating about the claim.

9. Good-Faith Statement

The notice should include a statement substantially confirming:

"I have a good-faith belief that the use of the material described in this notice is not authorized by the copyright owner, its agent, or the law."

Before submitting a notice, copyright owners should consider whether the disputed use may be legally authorized, licensed, or otherwise permitted under applicable copyright law.

10. Accuracy and Authority Statement

The notice should also include a statement substantially confirming:

"I state that the information in this notice is accurate and, under penalty of perjury, that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

11. Signature

A notice must contain a physical or electronic signature of:

  • The copyright owner; or
  • An authorized representative of the copyright owner.

For an electronic notice, typing the sender's full legal name may serve as an electronic signature where legally sufficient.

12. Sample DMCA Notice Format

A copyright owner or authorized representative may structure a notice as follows:

  • Subject: DMCA Copyright Infringement Notice
  • Copyright Owner: [Full legal name or company]
  • Authorized Representative: [Name, if applicable]

  • Accuracy and Authority Statement: I state that the information contained in this notice is accurate and, under penalty of perjury, that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Signature: [Physical or electronic signature]
  • Date: [Date]

13. Review of Copyright Notices

After receiving a sufficiently complete notice, Wearnorules may:

  • Review the information submitted.
  • Locate the identified material.
  • Request additional information where necessary.
  • Remove or disable access to the material where appropriate.
  • Notify the party responsible for the affected material where applicable.
  • Preserve records relating to the complaint.
  • Take other action required or permitted by law.

The response will depend on the facts and circumstances of each complaint.

14. Removal or Restriction of Content

Where a valid copyright complaint is received and appropriate action is required, Wearnorules may:

  • Remove the disputed material
  • Disable access to the disputed material
  • Remove a product image
  • Modify a product listing
  • Suspend affected content
  • Request proof of authorization
  • Take other reasonable corrective action

Removal does not necessarily constitute an admission that infringement occurred.

15. Counter-Notification

If material has been removed or disabled as a result of a copyright complaint and the affected party believes that the material was removed because of mistake or misidentification, that party may submit a counter-notification where permitted under applicable law.

Counter-notifications should be sent to:

  • Wearnorules – Copyright Compliance
  • Email: support@wearnorules.com
  • Mailing Address: 560 Norton Pkwy, New Haven, CT 06511-1634, United States
  • Recommended email subject: DMCA Counter-Notification

16. Requirements for a Counter-Notification

A counter-notification should include:

  • The physical or electronic signature of the person submitting the counter-notification.
  • Identification of the material that was removed or to which access was disabled.
  • Identification of the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that the person has a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  • The person's name.
  • The person's address.
  • The person's telephone number, where applicable.
  • A statement consenting to the jurisdiction of the appropriate United States Federal District Court as required by applicable law.
  • A statement accepting service of process from the person who submitted the original copyright notice or that person's agent.

A counter-notification that does not contain the required information may be considered incomplete.

17. Counter-Notification Statement

A counter-notification should include a statement substantially confirming:

"I state under penalty of perjury that I have a good-faith belief that the material identified above was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."

18. Consent to Jurisdiction

Where required under the DMCA, the person submitting a counter-notification must consent to the jurisdiction of the appropriate U.S. Federal District Court.

If the person's address is within the United States, this generally means the federal judicial district in which the person's address is located.

If the person's address is outside the United States, the applicable statutory jurisdiction provisions will apply.

The person must also agree to accept service of process from the party who submitted the original infringement notice or that party's agent.

19. Sample Counter-Notification Format

A counter-notification may be structured as follows:

  • Subject: DMCA Counter-Notification
  • Full Legal Name: [Name]
  • Contact Information: [Mailing address], [Email address], [Telephone number]
  • Removed Material: [Description of material]
  • Previous Location: [URL where the material appeared]
  • Good-Faith Statement: I state under penalty of perjury that I have a good-faith belief that the material described above was removed or disabled as a result of mistake or misidentification.
  • Jurisdiction and Service Statement: I consent to the jurisdiction of the appropriate United States Federal District Court as required under 17 U.S.C. § 512(g), and I agree to accept service of process from the person who submitted the original notification of claimed infringement or that person's agent.
  • Signature: [Physical or electronic signature]
  • Date: [Date]

20. Forwarding a Counter-Notification

Where applicable, after receiving a valid counter-notification, we may provide a copy to the party who submitted the original infringement notice.

The original complaining party may then have an opportunity to pursue appropriate legal action.

Information contained in the counter-notification may therefore be disclosed to the original claimant where required or permitted by law.

21. Restoration of Removed Material

Where applicable under the DMCA, material subject to a valid counter-notification may be restored or access may be reinstated no sooner than 10 business days and generally no later than 14 business days after receipt of the counter-notification unless we receive notice that the original complaining party has filed an action seeking a court order concerning the disputed material.

Restoration depends on applicable legal requirements and the circumstances of the dispute.

22. False or Misleading DMCA Notices

Copyright notices and counter-notifications should be submitted honestly and accurately.

Under applicable law, a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for resulting damages, costs, and attorneys' fees.

Do not submit a DMCA notice or counter-notification containing knowingly false information.

23. Fair Use and Other Authorized Uses

Not every use of copyrighted material constitutes infringement.

Depending on the circumstances, a use may be:

  • Licensed
  • Authorized by the copyright owner
  • In the public domain
  • Subject to fair use
  • Otherwise permitted by law

Copyright claimants should consider applicable legal limitations, exceptions, and permissions before submitting a takedown request.

24. Repeat Infringement

Where applicable and appropriate under the circumstances, Wearnorules may take action regarding parties who repeatedly submit or provide copyright-infringing material.

Action may include:

  • Removal of content
  • Restriction of access
  • Removal of listings
  • Suspension of applicable functionality
  • Termination of accounts or access where appropriate

Any action will depend on the nature and circumstances of the conduct.

25. Copyright Claims Concerning Product Images

If a complaint concerns a product photograph or other image, please provide:

  • The original image
  • Evidence of ownership
  • Original publication location
  • Original publication date, where known
  • Copyright registration information, if available
  • Exact Wearnorules URL displaying the image

Providing this information may help us review the claim efficiently.

26. Copyright Claims Concerning Written Content

If a complaint concerns text, product descriptions, articles, or other written materials, please provide:

  • The original copyrighted text
  • Evidence showing ownership or authorship
  • Original publication location
  • Relevant publication date
  • Exact URL containing the allegedly infringing text
  • Identification of the specific portions at issue

Generic facts, common expressions, product specifications, short phrases, and other material may not necessarily qualify for copyright protection.

27. Copyright Claims Concerning Multiple Works

If a complaint covers multiple copyrighted works appearing on our website, provide a representative list of the works where permitted by applicable law.

The notice should contain sufficient information for us to identify both the protected works and the allegedly infringing material.

28. Requests for Additional Information

We may request additional documentation if:

  • Copyright ownership is unclear
  • Authority to submit the claim is unclear
  • The identified material cannot be located
  • The notice is incomplete
  • Multiple parties claim ownership
  • The complained-of material appears to be licensed
  • Additional information is reasonably necessary to evaluate the complaint

Failure to provide sufficient information may delay or prevent further action.

29. Copyright Ownership Disputes

Wearnorules is not a court and does not independently adjudicate complex copyright ownership disputes.

Where ownership is disputed, we may request copyright registrations, contracts, assignments, licensing agreements, court orders, or other relevant documentation.

Parties may need to resolve complex ownership disputes directly or through appropriate legal proceedings.

30. Withdrawal of a DMCA Notice

If you submitted a DMCA notice and later wish to withdraw it, contact support@wearnorules.com.

Please provide:

  • Your full name
  • Date of the original notice
  • Identification of the disputed material
  • Relevant URL
  • Clear statement that you are withdrawing the complaint

We may verify the withdrawal before restoring or modifying affected content.

31. Withdrawal of a Counter-Notification

A party who submitted a counter-notification may contact us if they wish to withdraw it.

The request should clearly identify the original counter-notification, relevant material, relevant URL, date submitted, and requesting party.

32. Information Sharing

Information submitted in connection with a DMCA notice or counter-notification may be shared with the affected party, the original claimant, legal advisers, service providers assisting with claim administration, or courts and government authorities where required by law.

Do not include unnecessary confidential or sensitive information in a DMCA submission.

33. Privacy

Personal information submitted through the DMCA process will be handled in accordance with our Privacy Policy and applicable law.

We may retain information relating to copyright complaints where reasonably necessary for legal compliance, claim management, dispute resolution, fraud prevention, recordkeeping, and repeat infringement review.

34. No Abuse of the DMCA Process

The DMCA process should not be used to:

  • Remove lawful competing products
  • Suppress legitimate criticism
  • Resolve unrelated commercial disputes
  • Submit fraudulent claims
  • Make knowingly false ownership assertions
  • Harass another party
  • Remove content merely because the claimant dislikes it

Claims should concern genuine copyright issues.

35. Relationship With Trademark Claims

The DMCA primarily concerns copyright.

Complaints concerning trademarks, trade names, logos used as trademarks, trade dress, or other non-copyright intellectual property rights should generally be submitted under our Intellectual Property Claim Policy rather than through a DMCA notice.

36. Relationship With Our Intellectual Property Claim Policy

This DMCA Policy applies specifically to copyright matters under applicable U.S. copyright law.

Our Intellectual Property Claim Policy provides a broader procedure for concerns involving copyright, trademark, and other intellectual property rights. Where a complaint is specifically intended to invoke DMCA procedures, this DMCA Policy should be followed.

37. No Legal Advice

This page explains Wearnorules' copyright complaint process and does not constitute legal advice. Copyright law can be complex.

If you are uncertain whether you own a copyright, whether material infringes your copyright, whether a use qualifies as fair use, whether a DMCA notice is appropriate, or whether a counter-notification should be submitted, you may wish to consult a qualified legal professional before submitting a notice.

38. Designated Agent Requirements

U.S. law contains specific requirements for online service providers seeking certain limitations on copyright liability, including requirements relating to the designation and registration of a copyright agent.

Nothing in this policy should be interpreted as a representation regarding eligibility for any statutory limitation on liability beyond what is provided by applicable law.

Copyright notices concerning wearnorules.com may be submitted using the contact information provided in this policy.

39. Changes to This DMCA Policy

We may update this DMCA Policy to reflect changes in applicable copyright law, regulatory requirements, court decisions, operational changes, website changes, and changes in our copyright complaint procedures.

The current version will be published on wearnorules.com with an updated "Last Updated" date.
